Please read these Terms of Service (“Terms”) carefully before using the Savvy application (the “App” or “Product”).

By clicking “I Agree,” installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

The App is intended for adults aged 18 or older.

By using the App, you represent and warrant that:

  • You are at least 18 years old

  • You have the legal capacity to enter into this agreement.

The App is not intended for children, and children may not create accounts.

3. License

Seneka Inc. grants you a revocable, non-exclusive, non-transferable, limited license to install and use the App for your personal, non-commercial use, subject to these Terms.

You may not:

  • Sell, sublicense, rent, or redistribute the App

  • Reverse engineer or attempt to extract source code

  • Use the App for unlawful or prohibited purposes.

4. Health, wellness and medical disclaimer

Savvy is not a healthcare provider, and the App does not provide medical, psychological, or clinical advice.

The App and its features:

  • Do not diagnose conditions

  • Do not recommend treatments or medications

  • Do not replace professional care.

Any insights, summaries, or suggestions are provided for self-reflection and general wellness purposes only. You should consult a qualified professional for medical or mental health concerns.

5. HIPAA disclaimer

Savvy is not a “Covered Entity” or “Business Associate” as defined under the U.S. Health Insurance Portability and Accountability Act (“HIPAA”).

Information you choose to enter into the App is not Protected Health Information (PHI) under HIPAA, even if it relates to health or well-being.

If you export or share information from the App with a healthcare provider, that information may become subject to HIPAA only after it is received by that provider. Savvy is not responsible for third-party handling of shared data.

6. User content

You are solely responsible for any content you submit, record, or generate through the App (“User Content”).

You agree not to submit content that:

  • Is unlawful, harmful, defamatory, or invasive of privacy

  • Infringes third-party rights

  • Contains malware or malicious code.

You retain ownership of your User Content.

You grant Savvy a limited, non-exclusive, non-transferable license to use your User Content solely to:

  • Operate and provide the App

  • Perform transcription and AI processing

  • Generate summaries and personalized suggestions

  • Maintain, secure, and improve service reliability.

Savvy does not:

  • Use your content for advertising or marketing

  • Sell your content

  • Publicly distribute your content

  • Use your content outside service provision without your consent.

This license terminates when your content is deleted in accordance with our Privacy Policy.

7. Third-party services and AI

The App may rely on third-party services (including AI providers) to deliver functionality.

Savvy is not responsible for:

  • Third-party service outages or errors

  • Third-party terms or policies.

Your use of the App is subject to applicable third-party terms where required.

8. Privacy

Your use of the App is governed by our Privacy Policy, available at: https://www.savvykid.app/seneka-privacy-policy

By using the App, you acknowledge that you have read and understood the Privacy Policy.

9. Subscriptions and billing

The App offers the auto-renewing subscription options.

Your subscription will automatically renew at the end of each billing cycle unless canceled at least 24 hours before the renewal date. The payment will be charged to your App Store account at confirmation of purchase.

You can manage or cancel your subscription at any time through App Store settings. If you cancel during the trial period, you will not be charged. If you cancel after the trial period, your subscription will remain active until the end of the current billing cycle.

10. Termination

We may suspend or terminate your access at any time if:

  • You violate these Terms

  • Required by law

  • Necessary to protect users or the service.

You may stop using the App at any time.

11. Disclaimer of warranties

The App is provided “AS IS” and “AS AVAILABLE.”
To the maximum extent permitted by law, Savvy disclaims all warranties, express or implied.

12. Limitation of liability

To the maximum extent permitted by law, Savvy’s total liability shall not exceed the amount paid by you for the App, or USD $10, whichever is greater.

Savvy shall not be liable for indirect, incidental, or consequential damages.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules.

Arbitration and class action waiver provisions apply as set forth above.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated in the App or by other reasonable means.

Continued use of the App after changes means you accept the updated Terms.
